Terms & Conditions

Your registration is subject to these Terms & Conditions. By registering, you agree to and accept these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not register for, participate in, and/or use/consume any materials related to this event:

ASEV Representation or Misrepresentation — Please Exercise Caution!

ASEV encourages you to exercise caution for any solicitations for directory listings which often include advertising solicitations. There are many show directories that target attendees, sponsors and suppliers from other shows including ours. These solicitations are often mailed and appear to be from ASEV and they are not. Please be sure not to sign any form unless you carefully read the print on the form and are certain you understand what you are signing for. ASEV never mails a form to update your contact information with solicitation to advertise, etc. and our envelopes always include ASEV return mailing address in Davis, California. Please do not hesitate to contact us if you have any doubt about our representation in material you have received.

Endorsement & Opinions

ASEV provides a forum for the presentation, discussion and publication of research and technologi­cal developments for the promotion of education in enology and viticulture. ASEV does not endorse the products, services, or views of its members, program speakers or other delegates. The mention of products or services in the published abstracts or presentations of any form does not imply endorsement of these or other products. No endorsement of any kind should be inferred.

The ASEV is not responsible for statements, advice or opinions printed in its publications, given by program speakers and/or contained in program materials. Any such statements, advice or opinions solely represent the views of the authors, program speakers or the persons to whom they are credited, are not statements, advice or opinions of the ASEV and are not in any way binding on the ASEV.

Errors and Omissions

ASEV is not responsible for incorrect listings or typographical errors that may occur in any of ASEV publications, abstracts, materials and/or its website.

Intellectual Property Rights

ASEV retains exclusive intellectual property rights including to all printed material, art, content or other images, the sponsorship program, and program presentations. Any editorial use or commerce conducted other than as agreed to with ASEV in writing is a direct abuse and violation of intellectual property rights held by ASEV. These restrictions also pertain to any sales or promotional use of any audio, visual, or other technological reproduction or capturing of any aspect of the ASEV National Conference unless written authorization from ASEV is obtained in advance.

No Liability for Acts of God, Natural Disasters and Other Causes

ASEV shall not be liable for loss or damage that results from Acts of God, natural disasters, weather conditions, labor disputes, distribution of utility services, public authority, public enemy and acts of terrorism or war. If any of these events occur, ASEV reserves the right, in its sole discretion, to modify, reschedule, or cancel the ASEV conference and/or any associated events without obligation to anyone.

Presentations and Speakers

ASEV has developed a program which includes invited speakers. ASEV has received confirmation from all speakers at the time of publication but is not responsible for any changes or cancellations that may occur. No refunds will be made in this regard.

Recordings

Recording (audio, visual, other technological reproduction or screen shots) or capturing any aspects of the ASEV conference is prohibited unless authorized by ASEV in advance.

Registrant Database

ASEV creates a database of all registrants. Contact information is included in our Directory of Registrants which is available for sale. By registering for the conference, attendees authorize the use of his/her information in this database and the Directory of Registrants.

Mediation/Arbitration

In the event of any controversy, claim or dispute arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including determination of the scope or applicability of this Agreement (“Dispute”), the parties agree first to attempt in good faith to settle the dispute by mediation administered by JAMS under its applicable rules. If the parties cannot agree on a mediator, the mediator shall be selected by JAMS in accordance with its applicable rules.

All disputes not resolved by mediation shall be determined by arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures.  The mediator shall serve as arbitrator unless the parties agree to select a different person as arbitrator. The parties understand that this process will likely cause the arbitrator to receive information that might not otherwise have been received as evidence in the arbitration and to receive information confidentially from each of the parties that may not be disclosed to the other side.

The parties waive the right to seek disqualification of the arbitrator by reason of participation in the mediation and waive the right to seek to vacate any award on this basis. The parties also recognize that determinations that may ultimately be made by the arbitrator might be influenced by confidential information or other information received in the mediation. The parties waive the right to seek to vacate any arbitration award on this basis.

Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Indemnification

Except for the sole negligence or willful misconduct of ASEV, you agree to indemnify, defend and hold ASEV harmless from any loss, liability, costs or damages arising from actual or threatened claims or causes of action resulting from the acts and/or omissions (including but not limited to negligence in any form, whether active or passive) of ASEV or its respective officers, directors, employees, agents, contractors, members or participants (as applicable), provided that with respect to officers, directors employees, and agents, such individuals are acting within the scope of their employment or agency.

Use of Likeness

By registering for the event you agree to grant ASEV, its agents, and subcontractors your unrestricted permission to record, film, photograph, or capture your likeness at the event in any media now available or hereafter developed and to distribute, license, broadcast, transmit, transfer, publish, use, or otherwise globally to disseminate, in perpetuity, such media for any and all purposes, without any further approval from you or any payment to you. This grant to ASEV includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.  In exchange for your registration, you hereby release ASEV, its agents, and subcontractors from any and all claims that arise out of or are in any way connected with such use, including without limitation, any claim for defamation, slander, misappropriation or misuse of image, violation of moral or artist rights, violation of publicity rights, or invasion of privacy.

Ethics Policy and Code of Conduct

By attending any ASEV sponsored event, you agree voluntarily to abide by ASEV’s Ethics Policy and Code of Conduct approved by the ASEV Board of Directors on January 23, 2017.

ASEV Ethics Policy

The objectives of the Society shall be to encourage, stimulate, and support research in enology and viticulture or other sciences directly applied to enology or viticulture through its technical programs. Furthermore, the objectives shall be to provide forums for the presentation, discussion, and publication of such research and technological developments for the advancement of science and the promotion of education in enology and viticulture.

In accordance with this purpose, the Society encourages its members to:

  1. Treat all people with civility, avoiding harassment and discrimination,
  2. Uphold the highest standards of truthfulness and honesty in all scientific and professional endeavors,
  3. Evaluate the work of colleagues fairly and with open-mindedness,
  4. Recognize past and present contributors to science and not claim credit for accomplishments of others,
  5. Disclose potential conflicts of interest,
  6. Offer professional advice only on those subjects in which they are qualified,
  7. Expose scientific and professional misconduct promptly, and
  8. Comply with all laws and regulations that apply to our science and profession.
ASEV Code of Conduct

ASEV values the participation of all those who attend our events and want to ensure their experience is as productive and professionally stimulating as possible. ASEV is dedicated to providing a safe, hospitable, and productive environment for everyone attending our events, regardless of ethnicity, religion, disability, physical appearance, gender, or sexual orientation. It is important to remember that a community where people feel uncomfortable or threatened is neither healthy nor productive. Accordingly, ASEV prohibits intimidating, threatening, or harassing conduct during our conferences and all other ASEV sponsored activities. This policy applies to speakers, staff,  service providers, exhibitors, volunteers and attendees. Conference participants, in whatever capacity, violating these rules may be sanctioned or expelled from the conference, at the sole discretion of ASEV leadership.

Harassment of ASEV participants will not be tolerated in any form. Examples of harassment include offensive gestures or verbal comments related to ethnicity, religion, disability, physical appearance, gender, or sexual orientation in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, inappropriate use of nudity and/or sexual images in public spaces or in presentations, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome attention. Participants asked to stop any harassing or unwanted behavior are expected to comply immediately.

If a participant or exhibitor engages in harassing behavior, ASEV leadership, in their sole discretion, reserves the right to take any action they deem appropriate, ranging from a simple warning to the offender to expulsion from the event without warning or refund. The ASEV Board of Directors further reserves the right to prohibit attendance at any future events and conferences. Members engaging in harassing behavior may face termination of their ASEV membership.  If you are being harassed, notice that someone else is being harassed, or have any other concerns, please do not hesitate to contact ASEV staff who can work with appropriate ASEV leadership to provide assistance.
